Australia-Japan Foundation Grants Program Funding Conditions
- The Funding Recipient must only use the funds in accordance with the budget set out in Schedule 1.
- The Funding Recipient shall only use the funds for the purposes set out in Schedule 2.
- The funding agreement may be terminated, and the Foundation may take action to recover the grant funds, at any time if, in the reasonable opinion of the Foundation, the approved activities for which funding has been provided are not being carried out with competence and diligence, or the funding recipient is in breach of any provision in these conditions.
- Without prejudice to the availability of the remedy above, the Foundation may direct the recipient to rectify any breach of these conditions within seven (7) days of receiving written notice from the Foundation.
- If the funding is withdrawn by the Foundation for any reason, the recipient shall repay to the Foundation within seven (7) days of receipt of notice all monies provided by the Foundation.
- The monies constituting the funding shall be used only for carrying out the approved project, or the approved part of a project, in respect of which the funding has been awarded. Where the Foundation has agreed to provide funding for a component of a larger project, the monies shall only be used for those agreed activities and shall not be transferred to other aspects of the larger project, other than with the prior written agreement of the Foundation.
- The project for which funding has been provided shall not be undertaken by any other body or person other than the funding recipient, unless the Foundation has given prior written agreement.
- No substantial changes in the scope of the project for which the approved funding has been provided shall be made without the prior written agreement of the Foundation.
- The funding is valid only for the financial year for which it has been awarded. Agreement to provide funds is not transferable to a later year. If the commencement of the approved project or approved part of a project is delayed for any reason the recipient shall notify the Foundation immediately.
- The funding recipient shall notify the Foundation of any alternative or additional source of financial support in respect of the approved project, whether the additional funding has become available before or after the award of the Foundation funding.
- The funding will normally be payable only 4 to 8 weeks before commencement of the first activities of the approved project. Funding may be disbursed in instalments subject to the achievement of specified milestones,
- The Foundationfs support for a project, or a part of a project, must be acknowledged including wherever possible by use of the Foundationfs logo. The Foundationfs contribution must be acknowledged in publicity prepared for exhibitions, sporting fixtures, and in film and publication credits where this is appropriate.
- Where recipients have policies on treatment of sponsors and funding providers that might impinge on their ability to comply fully with paragraph 10 above, that policy shall be made known to the Foundation before funding is provided.
- The Foundation only provides funds for expenses specified in the funding approval. The host person/organisation must arrange separate funding for all costs other than those for which the Foundation has specifically accepted responsibility. The funding recipient should ensure that adequate arrangements have been made for the following, for which the Foundation does not accept any liability:
- medical/hospital insurance cover for persons not covered by Medicare in Australia or overseas; and
- any necessary insurance for equipment.
- Upon completion of the project or termination of funding under a condition of any kind, monies that have not been expended in accordance with the agreed project and the funding conditions shall be refunded to the Foundation.
- At any time where requested by the Foundation, the funding recipient shall provide a written report detailing progress of the project and the recipientfs compliance with funding conditions.
- Within thirty days of the completion of the project the funding recipient shall provide the Foundation with a:
- financial statement acquitting the monies within an Income and Expenditure statement for the whole project budget;
- written report according to the requirements of the Acquittal Report form
- Where the Foundation has provided funding of $5,000 or above (excluding GST), the financial statement should be signed by the same person, or by a person holding or acting in the same position as the person who signed this Agreement on the Recipientfs behalf. Where the Foundation has provided funding of under $5,000 (excluding GST) the financial statement should include supporting documentation such as used tickets/boarding passes, airline invoices and other receipts as appropriate. The Foundation will take recovery action if in the reasonable opinion of the Foundation the funding has not been acquitted adequately.
- The GST component provided in addition to the funding award must be appropriately remitted to the Australian Taxation Office.
- If a funding recipient fails to provide a satisfactory financial statement and completed Acquittal Report within thirty days of the agreed completion date of the project, the recipient may be ineligible for further funding from the Foundation.
- The funding recipient indemnifies and shall keep indemnified the Foundation, the Commonwealth, its officers, employees and agents from and against all actions, claims, demands, costs and expenses (including the costs of defending or settling any action, claim or demand) made, sustained, brought or prosecuted in any manner based upon , occasioned by or attributable to any injury to any person (including death) or loss of or damage to property which may arise from or be a consequence of any unlawful or negligent act or omission of the funding recipient, its officers, employees or agents in carrying out the approved project.
